I don't know if this counts as "threatening to sue" or "offering not to sue," but Phil Reese, public relations manager for Jenn Sterger, said on the Dan Patrick Show that he and his client would pursue no legal action against the NFL as long as Brett Favre gets suspended.
Sterger, of course, is the lady who is said to have received inappropriate voicemails from Favre, as well as inappropriate pictures.
Reese wants the NFL to act immediately. Dan asked if the NFL suspended Favre, would Sterger drop the whole thing. "If the commissioner suspends Favre and puts a program in place to prevent it from happening again ... 100 percent, Jenn would not pursue any litigation against Favre, against the Jets, against the NFL. Nothing. All she wants to do is clear her name. This is not about money," Reese said.
I hope that's true. From other comments I've read on the Internet, and emails I've received, I know a lot of people think Sterger's out for money.
Myself, I don't buy it, because one, she's not the one who made the story public to begin with, and two, I just can't imagine how she'd profit from this. I don't think there are a lot of book deals or Lifetime movie offers for ladies who have seen professional quarterback genitalia on a cell phone.
A few NFL media types more knowledgeable than myself have expressed doubt that Favre would be suspended.
I just want to see some kind of resolution soon. I have no idea why it's taken this long. If Favre did send the voicemails and pictures, he should be held accountable, just like anyone else. A woman has a right to go to work without dealing with someone's lewd digital come-ons.
And if he did nothing of the sort, then tell us that, NFL, and put the whole thing to bed. It's gone on too long already.

I'd have to do some research, and JDave can back me up on this, but depending on the exact claims she would bring and the applicable New York law, she's got to be quickly approaching the statutes of limitations for any claims she might have. Most tort claims typically have a 2-3 year at the very most statute of limitations. I imagine her attorneys are very aware of the fact and on top of it, but it seems like they're (camel)toeing the line.

JDave, law school has officially taken over my brain. I took my Conflicts of Law final yesterday (which wasn't the hardest I've taken, but certainly the most mentally exhausting) and while studying for it I thought of the Favre situation and turned it into a conflicts hypothetical. Sterger is a New York domiciliary and Favre is a Mississippi domiciliary, though he was residing in New York when the allegedly tortious conduct took place. If she filed in New York, the court would be able to assert personal jurisdiction over him because he purposefully availed himself to the state and had a continuous presence there. I imagine New York law procedural and substantive law would apply. Not sure if Brett has any defenses based on either Mississippi or even Minnesota law for a conflict to develop, or if Sterger would maybe try to use the Mississippi statute of limitations.
