Yes, Guido, he can "take this to a higher court." That means he can appeal the Judge's decision to dismiss the case to the United States Court of Appeals for the 5th Circuit. It will then take months, if not close to a year before they decide the limited issue of whether the District Court Judge abused her discretion by dismissing the case. If they rule that she did not, case over. If they rule that she did, they remand it to her and the case goes. Minimum year and a half from now before that point, unless the NFL magic keeps on fast tracking this case over other more deserving cases on the docket.

Vilma doesn't get to file this thing in the US Supreme Court and have an episode of law and order. I really think you fail to realize how boring and totally non-glamorous federal litigation is, especially at the appellate level.
